The terms "thetinylane", "we", "us" or "our" shall mean Pictree.
www.thetinylane.com (the “Site”) allows you to browse, select items for babies.(collectively "Process”).However, before you enter the website or use any of the www.thetinylane.com services, you must carefully review the Terms and Conditions set out below (the "Terms"). This Agreement sets forth the terms and conditions that apply to the use of the Site by the User. By using this Site, the User agrees to comply with all of the TERMS AND CONDITIONS hereof. (j) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
If a User participates in any of the above, the Company is entitled at any time and without obligation to give reasons, to deny the User the right to access the Site.

Product
The makers of +loom swaddles are xylemandloom , They have been in the industry for more than 25 years. Pictree has got the license to sell the product in India through its online selling platform www.thetinylane.com.
Account and Registration
It is the user's responsibility to keep the details of the account and password confidential and you agree to accept responsibility for all activities that occur under Your Account or Password. Thetinylane.com shall not be liable to any person for any loss or damage, which may arise because of any failure by the user to protect the account details or the password. In case of any suspected breach, please contact us immediately. If Thetinylane.com has reason to believe that there is likely to be a breach of security or misuse of the Thetinylane.com Site, we may require you to change your password or we may suspend your account without any liability to Thetinylane.com.com.
You also agree to:
- Provide true, accurate, current and complete information about yourself as prompted by Thetinylane.com website during the registration process (such information being the "Registration Data")
- Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. Pricing
www.thetinylane.com strives to provide users with the best prices possible on products. Prices and availability are subject to change without any prior notice. The pricing is subject to our pricing policy and the prices shall be determined only at our sole discretion. While we strive to provide accurate product and pricing information, pricing or typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We will have the right to modify the price of the product and contact you for further instructions using the email address or telephone number provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that we accept your order the same shall be debited to your credit card account. The payment may be processed prior to our dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.
Taxes
For all purchases below Rs. 1000/- GST of 5% and for purchases over and above Rs. 1000/- GST of 12% will be applicable.
Payment
Payments on www.thetinylane.com can be made through Credit Card, Debit Card or Net Banking. we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you out of the decline due to:
- lack of authorization for any transaction/s,
- or exceeding the preset limit mutually agreed by you and between your "Bank/s",
- or any payment issues arising out of the transaction,
- or decline of transaction for any other reason/s.
Credit /Debit card Details
User understands and confirms that the credit card details provided for availing of services on the Site will be correct and accurate and he/she shall not use a credit card which is not lawfully owned by them or in their name. User further agrees and undertakes to provide the correct and valid credit card details.
The company has taken reasonable care to make the website secure. All credit/ debit card transactions on the site are processed using a secure online payment gateway that encrypts your card details in a secure host environment. Credit card information will not be utilized, stored and/or shared by us with any of the third parties unless required for fraud verifications or by law, regulation or court order. We will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to prove otherwise' shall be exclusively on you.
Cancellation of order by the company
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.
Cancellation of order by user
In case we receive a cancellation notice and the order has not been shipped by us, we shall cancel the order and refund the entire amount. The orders that have already been shipped out by us will not be cancelled and you will have to check our return policy on those orders.. The User agrees not to dispute the decision made by us and accepts our decision regarding the cancellation.
Fraudulent / Declined Transaction
Users with more than one account or availing our services / discount fraudulently shall be liable for legal action under applicable law and we reserve the right to recover the cost of goods, collection charges and lawyer fees from the person using the Site fraudulently. We reserve the right to immediately delete such account and dishonour all past and pending orders without any liability. For the purpose of this clause, we shall owe no liability for any refunds.
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the present limit mutually agreed by us with our acquiring bank from time to time.
Shipping & Delivery
We aim to deliver orders within seven working days of orders being placed. However, sometimes during busy sale periods, deliveries may take longer. Please note that Saturday and Sunday are not classed as working days. If you have not received your delivery in seven working days please contact our Customer Services through support@thetinylane.com
Returns And Refunds Policy
In the event that a user is dissatisfied with the quality of the product, the Company may be contacted and reasonable measures shall be taken to rectify the issue to the best of the Company’s ability.
Damaged Products
All products are dispatched only after a quality check and in tamper-proof packaging. In the event that your product is damaged, please do not accept it and send us an email on support@thetinylane.com stating your order no and reasons for refusal of your acceptance. If the product is found damaged after you have opened it, please alert us via email and send us a picture showing the damage. We will respond to you in 24 hours and you will be told whether to ship the product back to us or not. If we are not alerted regarding the damage within 24 hours of your receipt, sale will be considered final. Also despite intimation, if the product is not received in a reasonable time frame it will not be accepted and sale will be considered final. On receipt of your intimation/product, we will replace your order at no additional costs to you, subject to availability of stock. In the event of unavailability of stock, we will give you a refund (via cheque or credit to your credit/debit card). Note the shipping cost has to be borne by the buyer.
Please note that Products will be accepted for return only if they are in their original packaging. Products on Sale may not be replaced.
Electronic Communications
When you visit the website or send emails to us, you are communicating with us electronically. You hereby provide your consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Website. You hereby agree that all notices, agreements and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Indemnity
You agree to defend, indemnify and hold harmless Thetinylane, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to us or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under this User Agreement or arising out of your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. The Indemnified Parties will control the defence of any claim to which this indemnity may apply, and in any event, you shall not settle any claim without the prior written approval of the Indemnified Parties.
Modification of Terms & Conditions of Service
Thetinylane.com reserves the right to make changes to our Terms of Use and/or our Privacy Policy (which is incorporated herein by reference) at our sole discretion and you may not be notified.
